The panel discussion, titled “Comparison of Practical Policies for Gifts and Hospitality in Different Asia Pacific Countries,” addressed business compliance initiatives, how to establish a practical hospitality program, and country-specific issues that may arise.
Bankruptcy lawyer Jeremy Hollembeak explored current issues in offshore cross-border insolvency matters, including how to develop global asset recovery strategies and the various tools available under U.S. law, on the panel titled, “Developments of common law of cross-border insolvency outside the EU framework – how Cayman could benefit.”
English barrister and U.S. lawyer Robin Rathmell discussed the availability and scope of freezing orders in foreign proceedings against defendants and third parties in England and Wales and in offshore jurisdictions.
On November 14, Rebecca Hume examined the issues faced in cross-border fraud disputes involving assets and creditors in multiple jurisdictions at the ABI Cross-Border Insolvency Program. The panel titled “Jurisdictional Issues in Cross-border Fraud,” covered the practical and legal concerns that may be encountered during a global dispute and the key strategies to find multijurisdictional solutions.
Michael Kim, firm co-founder and a member of the Seoul-based Government Enforcement Defense team, led a discussion at the International Bar Association’s Asia Pacific Regional Forum on Anti-Corruption Compliance and Enforcement conference in South Korea.
Trade secrets are an increasingly important form of intellectual property protection but also a source of business risk, with the FBI estimating that U.S. businesses suffer US $13 billion in losses annually. Losses come from departing employees, potential business partners who acquire confidential information under nondisclosure agreements, or data security breaches. Early- and growth-stage companies are often most at risk, having developed valuable technology or business information but not yet implementing inadequate controls.
