Kobre & Kim secured a significant victory for its clients in a high-profile civil RICO action brought by Uber Technologies, Inc. in the U.S. District Court for the Eastern District of New York.
The court granted defendants' motions to dismiss in their entirety and dismissed Uber's amended complaint. The court found that Uber failed to plausibly allege key elements required to sustain its RICO claims, including the existence of a RICO enterprise, conduct of an enterprise, a conspiracy, and a cognizable injury. The court also declined to exercise supplemental jurisdiction over Uber's remaining state-law claims, dismissing those claims as well.
The Kobre & Kim team represented the law firm, Wingate, Russotti, Shapiro, Moses & Halperin LLP and one of its partners. The court specifically accepted defendants' arguments that Uber's allegations reflected ordinary business relationships rather than the coordinated unlawful conduct necessary to support its RICO theories.
