Kobre & Kim Scores Win for MLB in Judgment-Enforcement Proceeding

In a win for Kobre & Kim client Major League Baseball Properties, Inc., a federal court has ordered a Dominican broadcasting company and its New York affiliate to turn over various kinds of property to MLB, including bank account funds in New York and the Dominican Republic, certain contractual payment rights, and a helicopter.

The order stems from a dispute between MLB and Telemicro over broadcast rights in the Dominican Republic. After Telemicro failed to pay for the rights, MLB initiated and won a US $6 million arbitration award.

In an order issued on March 24, U.S. District Judge Mary Kay Vyskocil of the Southern District of New York granted MLB’s request for Telemicro to turn over assets. Most notably, in her ruling, Judge Vyskocil found that MLB had demonstrated that a New York bank account held in the name of an affiliated company of Telemicro should be turned over as well because MLB had proven that Telemicro exercises “actual control” over the account.
