Understanding the evolution of Environmental, Social and Governance (ESG) enforcement remains key for business and legal professionals alike, as rapidly changing regulations are increasingly leading to unprecedented cases in the white-collar defense sphere.
Kobre & Kim’s Miranda Ching took part in a panel discussion held by the Women’s White Collar Defense Association (WWCDA) Thought Leadership Committee on September 25 in London. The speakers brought a cross-border perspective on criminal and regulatory enforcement in ESG. Ms. Ching was joined by moderator Sophie Wood of Kingsley Napley LLP, Maria Cronin of Peters & Peters and Katharina Humphrey of Gibson, Dunn & Crutcher LLP.
Ms. Ching addressed the differences between climate-related enforcement in the US and the UK, and shared her views on how supply chains may be impacted by recent UK case developments. She led a discussion focused on the purpose of criminal enforcement in the ESG sphere, and proposed that a preventive rather than the punitive approach should be considered by criminal enforcement agencies.
