The insolvency framework for Latin American debtors, coupled with strategic cross-border tactics, can create a powerful opportunity for monetizing debt claims in restructuring proceedings. Kobre & Kim’s New York and São Paulo teams, including Ana Frischtak, Daniel Saval, Donna Xu and Victor Clementino, hosted a Latin America asset recovery roundtable in New York on September 5, focused on U.S. Chapter 11 and 15 bankruptcy tools and beyond.
During the roundtable, the team led a discussion on the ever-changing world of asset recovery in Brazil and Latin America, as significant reforms in bankruptcy laws with creditor-friendly protections have been accompanied by soaring distressed debt throughout Latin America.
