Kobre & Kim’s Evelyn Sheehan will discuss the tensions that arise with the division of forfeited assets at the American Bankruptcy Institute’s Caribbean Insolvency Symposium in San Juan on February 4.
Fraudsters caught by the U.S. Department of Justice (DOJ), the U.S. Securities and Exchange Commission (SEC), and other agencies often have no other choice but to file for bankruptcy or they trigger the bankruptcy of related or affected entities. With experience in government enforcement actions and complex asset forfeiture matters, Ms. Sheehan will unpack how bankruptcy estates and Uncle Sam can avoid the risk of costly litigation by finding ways for the parallel proceedings to coordinate their efforts in order to maximize recovery for both the bankruptcy estate and crime victims.
The panel, entitled “The Bankruptcy Trustee vs. Uncle Sam: Dividing the Proceeds of the Crime,” will discuss the key terms of a successful cooperation agreement and lessons learned from three prior case studies.
