In an editorial, The Daily Journal has recognized Kobre & Kim’s Daniel Zaheer, who focuses on trade secrets disputes and patent infringement litigation, as one of their Top Trade Secrets Lawyers 2021, and they sat down with him to discuss his practice.
Mr. Zaheer observed that the trade secrets field has trended toward larger controversies into the nine- and ten-figures, “underscoring how technological innovations are a key to the growing economy.” He also explained how patent system reforms have narrowed the strength of patent protections, leading to litigants lean more on trade secrets law to protect intellectual property.
One example of this is Mr. Zaheer’s representation of Daewoong Pharmaceutical in one of the largest trade secrets cases of 2020. Allergen Inc. and Medytox Inc. sought to block the importation of Daewoong’s rival injectable neurotoxin. However, Mr. Zaheer and his team persuaded the U.S. International Trade Commission that this “cut[s] against trade secrets law,” a victory that led to a stay from the U.S. Court of Appeals and an eventual settlement.
“This is the way we litigate,” Mr. Zaheer said. “We saw the bacterium-as-a-trade-secret issue as a critical question that cut across the foundation of the other side’s case, and we designed our defense accordingly.”
