Kobre & Kim’s Michael Ng sat down with IAM to discuss emerging trade secrets trends and global competition of litigation forums in 2025, a process he expects to speed up in 2025.
“In 2024, we observed the acceleration of trends that have been developing over several years,” Mr. Ng noted. “We think gravitation toward the U.S. is a trend that will continue to increase in 2025, and that even more global disputes will come stateside for adjudication.”
Mr. Ng went on to share his thoughts on the trade secrets trends he will be watching for in 2025: “Most interesting to me is to see the emergence of competing legal regimes in a same way that we have in the patent world.”
Mr. Ng urged intellectual property managers to prepare for such competing trade secrets jurisdictions. “It’s important to make sure that if you are overseeing a cross-border company or business operation that has cross-border aspects, you maintain awareness of all the different parts of what the company is doing and can ensure that the way trade secret policies and procedures are implemented meets the most robust standards for protection internationally,” he explained.
