The U.S. lies at the crossroads of global commerce, so it is common for parties involved in disputes that arise outside of national lines to seek discovery within them. Hong Kong-based disputes lawyers John Han and Jason Kang discuss ways for litigants in foreign proceedings to use Section 1782 applications to obtain documents and testimony from third parties in the U.S. The authors explore the unique advantages offered under U.S. law, how to use the application, and special considerations for conducting discovery across borders.
