Multijurisdictional insolvencies have been on the rise in recent years, and with claims against directors and officers also becoming more common, overcoming jurisdictional and foreign law hurdles are key to effectively recovering against directors of companies in cross-border insolvencies. Rebecca Hume, Randall Arthur, Farrington Yates and Mark Griffiths, members of the firm’s global insolvency team, provide strategies for making claims in cases where the directors are not located in the same jurisdiction as the insolvency proceeding.
