U.S. and European regulators take very different approaches to handling white-collar criminal prosecution, making cross-border investigations a challenge. London-based former U.S. Department of Justice prosecutor Jason Masimore discusses the distinct approaches regulators in different jurisdictions take regarding whistleblowing, nonprosecution agreements and internal investigations in a recent Global Risk Regulator article. Mr. Masimore also explains the differences in data protection rules and sensitivities to which lawyers should be attuned when conducting cross-border investigations.
