In a recent opinion, the U.S. Supreme Court unanimously ruled that the U.S. Federal Trade Commission (FTC) does not have the authority to directly seek monetary relief. Kobre & Kim’s Benjamin Sirota sat down with Global Competition Review to comment on one notable aspect of the court’s opinion.
Interestingly, days before the ruling, all four FTC commissioners urged Congress at a Senate hearing to act if the court stripped the FTC of its power to seek monetary relief. Mr. Sirota indicated that the Supreme Court used this “as an implicit reason for why it could decide against the FTC.” He added, “it’s clear that the Supreme Court is going to take account of facts on the ground right until a decision is made.”
