Kobre & Kim’s Benjamin Sirota sat down with Bloomberg Law to discuss the upcoming trial on the merger between airline booking companies Farelogix and Sabre, offering his analysis of the Department of Justice’s (DOJ) case.
The merger between the two airline booking companies is the first antitrust case brought by the DOJ since AT&T’s acquisition of Time Warner. Critically, the DOJ must convince the judge that this merger is a horizontal one, a step Sirota considers achievable: “More often than not the government wins on product market definition.”
Sirota, who himself is a former DOJ Antitrust prosecutor, went on to add that the DOJ’s argument would be particularly strengthened “if there are business documents that support the way the government has defined the relevant market.”
