Andrew Stafford KC Featured in Global Arbitration Review Discussion on Cross-Border Award Enforcement

Kobre & Kim's Andrew Stafford KC was featured in a recent Global Arbitration Review conference report examining key developments in international investment arbitration and sovereign award enforcement. The report highlighted discussions from the International Federation for Investment Law and Arbitration's (IFILA) Annual Conference in London.

As part of a panel on North American perspectives, Andrew discussed how recent developments in Washington, DC involving sovereign immunity and the enforcement of investment treaty awards are being closely monitored by courts and practitioners in other jurisdictions, including England, particularly where disputes raise questions regarding the interaction between international obligations and domestic law.

The discussion also explored enforcement against state-owned enterprises and the differing approaches taken by U.S. and English courts. As noted in the report, the broader discovery tools available in the United States can provide award creditors with earlier access to information regarding assets, ownership structures and state control, creating important strategic considerations for parties pursuing sovereign-linked assets.
