The DOJ’s recent pause on Foreign Corrupt Practices Act (FCPA) enforcement continues to fuel debate and spark concerns among those keeping an eye on Latin America. While some proponents of the pause suggest it allows U.S. companies to compete more effectively against foreign firms not bound by similar regulations, some perceive it as a retreat from anti-corruption commitments, potentially emboldening corrupt practices in the region.

Kobre & Kim’s Adriana Riviere-Badell shared her insights with Law.com, noting that the pause provides a welcome reprieve for U.S. entities facing enforcement risks abroad. “I do think that United States prosecutors have overstepped the bounds of extraterritorial jurisdiction,” she said, calling the trend of recent years “a bit imperialist.”
