The international arbitration award enforcement landscape has seen major developments over the past year. Kobre & Kim’s Adriana Riviere-Badell, who focuses on international judgment enforcement and asset recovery, explored what this means for practitioners during the 12th Annual Atlanta International Arbitration Society (AtlAS) Conference in Atlanta, Georgia, on a panel on October 5, 2023.
The panel, “Issues in Arbitration Award Enforcement,” examined developments such as the federal District of Delaware clearing the path for auctioning Venezuela’s U.S. assets; groundbreaking rulings by DC federal courts concerning “intra-EU” and Energy Charter treaty award enforcement; the massive Yukos award making its way through the U.S. courts; and other cases and issues.
Ms. Riviere-Badell focused in particular on recent developments related to significant arbitrations and arbitration awards emerging from Latin America, and strategies for award holders seeking to monetize claims against Latin American sovereigns.
Joining Ms. Riviere-Badell were panel moderator Timothy Nelson of Skadden Arps Slate Meagher & Flom; Thomas Childs of King & Spalding; Nilufar Hossain of Omni Bridgeway; and Thomas Walsh of Freshfields Bruckhaus Deringer.
Ms. Riviere-Badell concentrates her practice on high-profile contentious trust and estate disputes, complex multi-jurisdictional civil litigation — including appellate proceedings — and international judgment enforcement and asset recovery, with a focus on Latin America. She was recently recognized among "Latin America's Top 100 Female Lawyers" by Latinvex.
