John Han Discusses Cross-Border Accountability in China and Japan in Trial Magazine

Kobre & Kim’s John Han, alongside Cohen Milstein’s Adam Langino, discussed challenges that lawyers face when attempting to serve defendants and enforce judgments in mainland China and Japan in the November edition of Trial Magazine.

The team discussed how compliance with the Hague Service Convention is required when serving defendants in Japan, while also providing tips for the process of filling Form USM-94. They also offered similar advice on serving defendants in China, including specific mailing instructions for Form USM-94 and advice on what to do when faced with a service that is delayed under the same convention.

The article also delved into the process of  enforcing judgments in Japan and China, including insights into which district courts to file judgments with in Japan and guidelines for exporting defendant judgments to other jurisdictions when the original enforcement is not recognized by Chinese courts.
