Sam Stern is a trial lawyer who concentrates on government enforcement defense and internal investigations. In particular, Mr. Stern litigates cases involving health care fraud, Foreign Corrupt Practices Act (FCPA) violations, and financial crimes including tax evasion and insider trading. 

He also represents clients in civil litigation, particularly in disputes related to complex investment structures and other financial products and services.

Prior to joining Kobre & Kim, Mr. Stern served as a prosecutor in the White Collar Crimes Unit of the Palm Beach County State Attorney’s Office in Florida and in the Appeals and Criminal divisions of the U.S. Attorney’s Office for the District of New Jersey. 

He teaches courtroom strategy as a member of the faculty at the University of Virginia School of Law Trial Advocacy Institute.

Select Engagements

  • Trial counsel for Dr. Salomon Melgen, co-defendant alongside U.S. Senator Robert Menendez, in the highly publicized U.S. Department of Justice (DOJ) corruption case, resulting in a hung jury after a two-month trial, which was widely reported as a victory for the defense. Following the mistrial, the court granted our motion for judgment of acquittal on seven of the 18 counts charged, resulting in the DOJ’s dropping the case entirely by dismissing all remaining charges with prejudice.
  • Representation of an in-house lawyer of an orthopedic device company in connection with an investigation being conducted by the DOJ and the U.S. Securities and Exchange Commission (SEC) in regard to a Foreign Corrupt Practices Act (FCPA) investigation.
  • Representation of the former CEO of a Florida-based health care provider in an investigation being conducted by the Public Corruption Unit of the State Attorney's Office.
  • Representation of the Federal Housing Finance Agency (FHFA), a U.S. government agency serving as conservator for Fannie Mae and Freddie Mac, against various major Wall Street banks (including Bank of America, JP Morgan Chase, Merrill Lynch, and Credit Suisse) in litigation concerning mortgage-backed securities.
