What Florida Lawyers Need to Know About Internal Investigations in the People’s Republic of China

As China solidifies its position as a global financial superpower, leaders in China and worldwide have increased efforts to curb systemic corruption. In a recent article, Miami-based lawyer Adriana Riviere-Badell and former U.S. Securities and Exchange Commission enforcement lawyer William McGovern discuss special considerations for multinational companies with interests in China when conducting internal investigations in the region. The article provides advice particular to lawyers based in Florida and elsewhere in the U.S., including how to navigate different legal frameworks, data protection regulations, state secret laws and confidentiality standards of attorney-client communications. The authors, which also include Beau Barnes and Nan Wang, also consider the ways these stark legal differences are magnified through the lens of cultural and language differences.
