Sergio Aguiar Discusses Evolving Strategies in Special Situations Investing

On April 28, Kobre & Kim’s Sergio Aguiar spoke at the Special Situations Exchange Brazil conference in São Paulo, on cross-border deals and how investors are adapting to an increasingly complex distressed and special situations landscape.

Drawing on his experience advising investors on cross‑border recoveries, Sergio discussed how the market has moved beyond a focus on access to stressed assets alone. As debtors have become more sophisticated and returns more tightly priced, value creation is now often driven by execution—including litigation, enforcement, and jurisdictional strategy—with investors underwriting credit around defined exit and recovery pathways from the outset.

Sergio also highlighted how Brazilian investors are increasingly repositioning matters globally when domestic remedies fall short, combining early‑stage asset tracing with coordinated, multi‑jurisdictional legal tools. He noted that targeted use of offshore jurisdictions, creditor‑friendly forums, and enforcement mechanisms can be critical to unlocking value where assets are held within complex international structures.
