Robin Rathmell on the Role of Trustees in Civil and Criminal Fraud Proceedings

Kobre & Kim’s Robin Rathmell will join Addys Schmitt, Sue Millar and Brian Lacy to participate in an interactive discussion on the role of trustees in managing fraud claims under both civil and criminal fraud proceedings at LegalWeek’s Trusts & Estates Litigation Forum 2020 in Marrakech, Morocco, on February 27.

Offshore trusts are well-known for their role in the wealth structure of ultra-high net worth individuals. In turn, these structures attract suspicion and allegations (both founded and unfounded) of fraud from both private litigants and government authorities. The session, entitled “Trustees: Claimant, investigator and prisoner?” will explore several questions about the trustee’s role in these situations, including how they can manage fraud claims under civil fraud litigation, what the impact from those claims is, as well as what the correlation is between civil and criminal proceedings.
