Martin De Luca on Corporate Plea Bargains

On September 14, 2022, Martin De Luca was invited by Professor Pedro Iokoi to give a lecture on corporate plea bargaining in the U.S. to a post-graduate class of Compliance at Ibmec, a private research university in Brazil. The class was composed of several compliance officers in Brazilian financial institutions and publicly traded companies.
When corporate entities or their officers are investigated and charged by U.S. enforcement agencies, plea bargains are often initiated to achieve favorable results for both the corporate defendant and the prosecution without having to resort to a trial. Mr. De Luca explored the various considerations that are critical in these negotiations for companies and steps that compliance officers can take to help U.S. counsel achieve better outcomes.
