Gabriela Menna Barreto shares strategies for cross-border asset tracing at the Turnaround Management Association’s 9th Congress in São Paulo, Brazil. Ms. Barreto offers tips for conducting an effective asset search, including backward and forward tracing. She also discusses the pros and cons of conducting an independent asset discovery versus judicial asset discovery and explores specific tools available to creditors in the U.S., including the § 1782 application and Chapter 15 of the U.S. Bankruptcy Code. Ms. Barreto, a Brazilian-trained lawyer, also shares differences and special considerations for U.S. cases that overlap with Brazilian judicial proceedings.
The panel discussion, titled “Fraud During Crisis: Asset Dissipation, Asset Tracing, Co-Mingling of Assets and Bankruptcy,” will be held Tuesday, November 7.
