Kobre & Kim's Carolina Leung spoke at a breakfast event organized with Gabriela Ruiz of King & Ruiz LLP on the latest shifts in U.S. cross-border litigation and why they matter.
Representing Kobre & Kim, Carolina shared that the U.S. legal framework is particularly well suited for the resolution of complex disputes, especially those involving trade secrets and transnational matters. She highlighted the Defend Trade Secrets Act (DTSA), which expanded the scope of federal jurisdiction and enables cases with impact on the U.S. market to be adjudicated even when elements of misconduct occur abroad.
The discussion also planted a seed for Brazilian parties to consider the U.S. as a forum to bring their disputes, even when the underlying dispute itself is primarily taking place in Brazil.
