Kobre & Kim has contributed to the Cayman Islands and Hong Kong chapters of the 2016 edition of Getting the Deal Through: Enforcement of Foreign Judgments. James Corbett KC, Jalil Asif KC, and Pamella Mitchell co-authored the chapter on the enforcement of foreign judgments in the Cayman Islands. In this chapter, the authors explore key pieces of legislation to consider in private investigations, parallel proceedings, forum choice, and funding and costs. Randall Arthur and Gabrielle Liu also co-authored a chapter on the enforcement of foreign judgments in Hong Kong. The key issues they addressed include requirements for recognition, defenses, limitation periods and the enforcement process. The chapters, presented in Q&A format, provide an overview of protections and rights afforded by each jurisdiction and the ways that each country’s legal system aids in the enforcement of foreign judgments.
